Can the Regional Plan be de-notified?

– The Congress Legislature Party (CLP) decision bewildered many but the main question that was being asked was whether there is a legal provision in the law to de-notify the Regional Plan. This was one of the main grounds that prompted those in political circles and builders’ lobby in the last many days, to say that the government would not be able to scrap the Plan.

Their point was that there is no provision in the Town & Country Planning Act for de-notification of Regional Plan. In fact, on Wednesday night, while talking to a group of reporters, Chief Minister Pratapsing Rane had said that the demand of Goa Bachao Abhiyan for scrapping of the Plan cannot be met as there is no such provision in the TCP Act.

But at Thursday’s CLP meeting Advocate General Subodh Kantak opined that de-notification is possible and explained the procedure for it. Law Minister Dayanand Narvekar, later queried by reporters, also said that if the government can notify the Plan, it has powers to de-notify it as well.

The chief minister, when quizzed at the press conference, said that initially it was felt that it was not possible to rescind it but “we have been told that it can be de-notified.” Chief Secretary J P Singh also stated that the government has powers to de-notify the Regional Plan.
