Ordinance to axe Plan 2011 promulgated

PANJIM, FEB 5 – An Ordinance was tonight promulgated by the Governor S C Jamir empowering the government to amend Town & Country Planning (TCP) for withdrawing a Regional Plan.

This Ordinance now would pave the way for denotifying the controversial Regional Plan 2011 with retrospective effect, sources said.
Earlier in the day, the Rane Cabinet approved the decision authorising the government to amend TCP Act to denotify a regional plan. This process which was initiated two days ago was completed by circulation, meaning that the file was circulated to all the Cabinet ministers without a meeting being convened.
Today evening, the Cabinet decision was conveyed to the governor for approval. Generally, amendments to State laws (Acts) are to be passed in the legislative assembly but when the assembly is not in session and important matters are to be approved, an Ordinance is issued for the purpose.
Based on today’s Ordinance, chief town planner would issue a notification stating that once the notification is issued, no person or institution, etc would be entitled for undertaking any development in terms of the withdrawn Regional Plan and that the development would be on the basis of the pre-existing RP, the sources said.
It may be recalled that compelled by public protests, Chief Minister Pratapsing Rane had decided on Republic Day that the Regional Plan 2011 would be denotified with retrospective effect.
The law department however was of the view that to do so, the TCP Act has to be amended to withdraw the Plan.
Last month, the chief minister as well as the law minister had said that the government could denotify the RP2011 without amending the TCP Act. However, treading a cautious path which was also seen by some as part of delaying tactics, the government eventually decided to go for amending the TCP Act empowering the government to scrap RP.
